Forms Update - July 2025

It's that time of year for another round of forms updates. This cycle includes primarily minor adjustments, with most changes focused on updated verbiage across several forms.
Highlights:
Residential Purchase Agreement (RPA)
A small revision was made to clarify seller payment to the buyer’s broker. The term “Buyer’s broker” has been
explicitly added. Additionally, the Buyer's Affirmation of having a valid buyer broker agreement has been
removed.Section 19D now includes instructions to escrow regarding commission payments and any buyer
payment offsets.
Related Form Revisions
These updates also affect related forms, including purchase agreements for income properties, notice of default
properties, commercial transactions, and others.
ADM - Addendum Updates
The preprinted checkbox option related to the TDS has been removed.
Language has been added directing users to utilize Form APD for changes to the TDS or SPQ, and Form AEA for modifications to an already executed agreement.
New Addendum – ADM-GEN
This new form was created for documenting any agreed-upon changes between an agent and their client.
NOTE ON BRBC – Buyer Representation and Broker Compensation Agreement:
This form serves to formalize the relationship and compensation agreement between a buyer and their broker. It’s important to note that neither C.A.R. nor N.A.R. requires brokers or agents to disclose the terms of their compensation agreements with clients to other brokers/sellers. It is not appropriate for one broker to interfere in another broker's agreement with their client. The validity or structure of a fellow agent’s contract is not the business of cooperating agents or brokers.
Fire Hardening & Defensible Space Addendum
A new section has been added with questions regarding any completed low-cost fire hardening retrofits.
PRBS – Possible Representation of More Than One Buyer or Seller:
This form has been expanded from one page to two and completely reformatted. A new paragraph (C2) has been added to address single-agent dual agency, providing greater clarity and compliance guidance.
New Form – SIPA: Seller in Possession Advisory:
This advisory informs all parties of the risks and considerations involved when a seller remains in the property after close of escrow. It outlines potential complications—such as the situation evolving into a lease, insurance concerns, and lender objections to extended occupancy. This form helps protect you, the agent, by documenting that these issues were disclosed and discussed in advance.
